Terms of Service

1. General Provisions

These Terms of Service ("Terms") govern the use of the ezStay platform ("Service"), a digital guestbook and property guide tool for accommodation hosts.

The Service is operated by [TODO: Company Name], NIP: [TODO: NIP], with registered address at [TODO: Registered Address], email: support@ezstay.eu (hereinafter referred to as the "Operator").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Definitions

  • Service — the ezStay web application, accessible at ezstay.eu, including all features and functionality
  • User — any natural or legal person who creates an account and uses the Service
  • Guestbook / Guide — a digital property information page created by a User, containing details such as check-in instructions, WiFi credentials, house rules, and local recommendations
  • Subscription — a paid plan that grants access to premium features of the Service
  • Digital Content — any digital materials provided through the Service, including templates, generated QR codes, and translated content

3. Registration & Account

To use the Service, you must create an account by providing a valid email address or by signing in through Google authentication.

You are responsible for:

  • Providing accurate and up-to-date information
  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account

You must be at least 18 years old or the age of majority in your jurisdiction to create an account. The Operator reserves the right to refuse registration or suspend accounts that violate these Terms.

4. Service Scope

The Service allows Users to:

  • Create and manage digital guest arrival guides and property guides for their guests
  • Add content including arrival instructions, WiFi details, access codes, house rules, custom pages, contact information, and alert messages
  • Generate shareable links and QR codes for guest access
  • Display weather forecasts based on property location (powered by Open-Meteo)
  • Translate guest arrival guide content into multiple languages (powered by DeepL)
  • Upload images for property covers, arrival steps, and contact photos

The Operator provides the Service "as is" and continuously works to improve and expand its features.

5. Technology Stack

The Service is built using modern web technologies to ensure reliability, performance, and security:

  • Next.js 16 (React) — powers the frontend interface and API routes
  • Supabase (PostgreSQL) — provides database hosting, user authentication, and file storage
  • Stripe — handles all payment processing and subscription management
  • Vercel — hosts the application and provides global CDN delivery
  • DeepL API — enables automatic content translation into multiple languages
  • Open-Meteo — supplies weather forecast data based on property coordinates

The Operator selects and monitors all technology providers to ensure they meet security and data protection standards.

6. Subscriptions & Payments

The Service offers the following plans:

  • Basic (Free) — includes limited guest arrival guides with core features
  • Premium (Paid) — includes unlimited guest arrival guides and advanced features

Paid subscriptions are processed through Stripe. By subscribing, you agree to Stripe's Terms of Service.

Key payment terms:

  • Subscriptions are billed monthly or annually, depending on the plan selected
  • Subscriptions auto-renew at the end of each billing period unless cancelled
  • Prices are displayed inclusive of applicable taxes
  • The Operator reserves the right to change pricing with at least 30 days' notice
  • Refunds are available within 14 days of purchase in accordance with consumer protection laws

7. Right of Withdrawal & Refunds

If you are a consumer within the European Union or Poland, you have the right to withdraw from a distance contract within 14 days of purchase, without giving any reason (Art. 27 of the Polish Consumer Rights Act of 30 May 2014).

How to request a refund:

  • Send an email to support@ezstay.eu with the subject "Withdrawal" or "Refund request"
  • Include your account email and the date of purchase
  • You do not need to provide a reason

You may also use the following model withdrawal form (not obligatory): "To: [TODO: Company Name], [TODO: Registered Address], support@ezstay.eu. I hereby give notice that I withdraw from my contract for the provision of the ezStay subscription service, ordered on [date]. Name: [your name], Email: [your email], Date: [today's date]."

The 14-day withdrawal period starts from the day the contract was concluded (i.e., the day you subscribed).

Exceptions: The right of withdrawal does not apply to digital content that has been fully delivered with your prior express consent and acknowledgment that this waives your right of withdrawal, in accordance with Article 38 of Directive 2011/83/EU and Art. 38 point 13 of the Polish Consumer Rights Act. During the subscription process, you will be asked to expressly consent to the immediate commencement of the service and acknowledge the loss of the withdrawal right.

Refund processing: If your withdrawal is accepted, we will reimburse all payments received within 14 days using the same payment method you used for the original transaction. No fees will be charged for the refund. This is separate from account cancellation described in Section 12 — the 14-day withdrawal right provides a full refund regardless of usage.

8. Intellectual Property

All intellectual property rights in the Service — including but not limited to the software, design, logos, trademarks, and documentation — belong to the Operator or its licensors.

You retain full ownership of all content you create and upload to the Service (text, images, property information). By using the Service, you grant the Operator a limited, non-exclusive, worldwide license to host, display, and distribute your content solely for the purpose of providing the Service to you and your guests.

9. User Content

You are solely responsible for all content you create, upload, or share through the Service.

You represent and warrant that:

  • Your content does not infringe any third-party rights (copyright, trademark, privacy)
  • Your content does not contain illegal, harmful, or misleading material
  • All information provided in your guest arrival guides is accurate and up-to-date

The Operator reserves the right to remove content that violates these Terms or applicable law, with or without prior notice.

10. Complaints

If you have a complaint regarding the Service, please contact us at support@ezstay.eu.

We will acknowledge your complaint within 3 business days and endeavor to resolve it within 14 days.

For consumers in the EU, you may also use the Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/

Consumers in Poland may also seek assistance from municipal or county consumer ombudsmen, or relevant trade inspection authorities.

11. Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

The Operator shall not be liable for:

  • Temporary unavailability of the Service due to maintenance, updates, or technical issues
  • Loss of data resulting from circumstances beyond the Operator's reasonable control
  • Actions of third-party service providers (Stripe, Supabase, Vercel, DeepL)
  • Inaccuracies in weather data or automated translations
  • Any indirect, consequential, or incidental damages

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, or fraud.

12. Contract Termination & Account Deletion

How to delete your account:

  • Option 1: Go to Settings in the app and use the account deletion option
  • Option 2: Send an email to support@ezstay.eu with the subject "Account Deletion Request"

We will process your request within 3 business days.

Upon account deletion:

  • Your guestbooks will immediately become inaccessible to guests
  • All your personal data and content will be permanently deleted within 30 days
  • Billing and transaction records will be retained for 5 years as required by Polish tax law
  • If you have an active subscription, it will be cancelled and no further charges will be made. No pro-rated refund is given for the remaining billing period unless required by applicable law

The Operator may terminate or suspend your account if:

  • You materially breach these Terms
  • You use the Service for illegal purposes
  • Your account has been inactive for more than 12 months (with 30 days prior notice)

Before termination for breach, the Operator will provide reasonable notice and an opportunity to cure the violation, except in cases of severe or repeated violations.

13. Final Provisions

These Terms are governed by the laws of the Republic of Poland.

For consumers, mandatory consumer protection provisions of the consumer's country of residence apply where they provide greater protection.

Any disputes shall be submitted to the competent court for the Operator's registered address, except for consumer disputes, which may be brought before the court of the consumer's residence.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

These Terms are effective as of the date indicated at the top of this document.
